Who can draw up Land Registry lease plans? Your options

If you're in need of a lease plan to submit to the Land Registry, it's important to ensure that it is produced by the right supplier. The Land Registry has a number of guidelines, and compliance with these is essential - otherwise you could find that your plan is rejected, causing unnecessary delays, cost and hassle.

But who can draw up a lease plan for you, and is it possible to do it yourself? Today we're taking a closer look at your options.

Who can prepare a Land Registry compliant lease plan?

Theoretically, anyone who has a strong knowledge of the Land Registry requirements and access to the skills and equipment necessary to measure property and produce scaled plans can prepare a lease plan - it does not need to be someone with a specific qualification or profession.

However, the expertise in Land Registry criteria is exceptionally important to ensure that it is accepted, so we would not recommend producing one yourself. You will generally find that you are able to get a lease plan from a number of sources involved in property transactions - however, not all of these will actually produce the plan themselves.

Surveyors

You will likely be able to get a lease plan drawn up via your surveyor, who should have a good level of knowledge on what needs to be included on it. However, they may not have the expertise to produce them plan themselves, and would usually outsource the production to a third party on your behalf.

Solicitors

Similarly, most solicitors will be able to arrange to have a lease plan drawn up for you, but would outsource the production of this to another organisation that specialises in lease plans - like us!

While you do not necessarily need a solicitor to produce a lease plan, you should certainly get them involved with the lease agreement itself.

Architects

You may also be able to get a lease plan via your architect. Architects have both the knowledge needed and the technical ability to produce lease plans. It's worth noting that if your architect is producing the lease plan themselves rather than outsourcing it to a third party, they are likely to charge considerably more on account of working to a higher hourly rate.

Lease plan professionals

There are also specialists that focus on lease plans and related documents, such as ourselves.

Companies like ours are actually the main providers of lease plans for the above professions; many of our customers are surveyors and solicitors arranging to have a lease plan drawn up on their client's behalf. Choosing a lease plan professional has the benefit of costing less than an architect, while having access to the expertise, technical ability and the relevant equipment to be able to create them efficiently and accurately.

Can you draw up your own lease plan?

It is possible to draw up your own lease plan only if you have a solid understanding of the Land Registry requirements, and the technical expertise to be able to produce it. If you have experience in floor planning, property measurements, using CAD software, and a robust grip on the criteria, then there is nothing stopping you from creating your own lease plan.

However - and very importantly - if you have overestimated your knowledge or understanding and create the plan yourself, then you risk your lease plan being rejected. In turn this can cause significant delays to your property transaction as well as unneeded hassle to the process. For this reason, we would recommend only attempting this if you are absolutely sure it is something you can achieve; you may not need any official qualification, but you do need some expertise!

Ensuring your lease plan is Land Registry compliant

It is not unusual for us to hear from clients that they have tried to produce a plan themselves but have found that it has been rejected by the Land Registry (sometimes multiple times!). To avoid this, ensure that you have it drawn up by a trusted source that is actually an expert in these matters - if you have to have your plan created more than once, you won't save anything at all by attempting to cut costs along the way.
